IMPORTANT BOOKING INFORMATION

1. There is a non-refundable 50% deposit required to reserve your date and time, however, you may also pay in full upfront if you wish to do so.
2. A transportation cost may apply depending on the location of the shoot (this cost is not standard and is not a part of the prices quoted).*
3. If you miss your entire session, that will be considered as a cancellation considering you didn't show up.
4. If there is a need to reschedule this must be done before the date of your shoot.
5. Please be on time for your session so we can have an awesome experience; if you are more than 30 mins late, you will be charged for the additional time.
6. It is advised to arrive at least 30 mins before your session. The time set for your photoshoot is not the arrival time, but the time the session begins.
7. LSALM Photography retains the copyright to all images taken unless other agreement was made prior.
8. Unless otherwise agreed upon, once you book a shoot, you automatically agree to an exclusive model release. 

Wedding Photography Contract

This contract represents the entire understanding of the requirements, schedule, and payment terms for the wedding photography services. If there are any disputes or actions resulting in legal proceedings related to this contract, such actions shall take place in and be subject to the laws of Jamaica. Clients accept sole financial responsibility for any legal fees or related costs incurred by the Photographer in enforcing the terms of this wedding photography contract. 

Payment

The Clients agree to paying a non-refundable initial payment totaling no less than 50% (fifty-percent) of the total price of the photography services upon signing this contract. The initial payment reserves the photographer’s time and is not a retainer. Clients acknowledges that no reservation can be secured prior to the signing of this contract and subsequent initial payment. The remaining balance for the above-listed wedding photography services shall be due in full no later than the ceremony date before shooting commences. In the event that payment is not made in full by this deadline, Photographer reserves the right to retain the initial deposit, and no longer be held liable for providing further services to the Clients. Direct payment and bank transfers are preferred, however, cheques are also accepted. No reservation/booking is final until cheque clears.

Cancellation

The Clients may cancel this contract at any time up to 30 days prior to the ceremony date. To do so, Clients must send a written cancellation notice via either email or certified mail. The Clients hereby forfeit their initial deposit in case of cancellation and agree to pay the full amount for the services listed above should they cancel this wedding photography contract within 30 days prior to the ceremony date.

Reschedule

Client may reschedule the date stipulated up to 30 days prior to the ceremony date with the written approval of the Photographer. Should the Photographer be unable to accommodate the Client’s rescheduled date, the Clients will still be held responsible for the remaining balance of this wedding photography contract and will forfeit their initial deposit.

Limit of Liability

In the unlikely event that the Photographer is unable to perform to the guidelines of this contract due to injury, illness, act of God, act of terrorism, or other cause beyond the control of the Photographer, the Photographer will make every effort to secure a replacement. If the situation should occur and a suitable replacement can not be found, responsibility and liability is limited to the return of all payments received for the event, not including the initial deposit and transportation costs if applicable. This limitation of liability does not apply to any loss or damage to footage, photographs or other materials after the events listed in this contract. As it pertains to optional add-ons such as video services, music, make-up, etc, if there is an inability to perform duties on the day, on-premises, for whatever reason, the sole remedy shall be limited to a refund of 50% of monies paid by the Client to the Photographer for the respective add-on service.

Digital Media

The Clients acknowledge that the Photographer does not maintain archives of images and footage after delivering requested images and other goods to the Clients. It is the Client’s sole responsibility to request any desired prints, products, or files within 7 days of receiving images.

Pricing

Any additional goods or services not included in this wedding photography contract will be sold at then-current rates. Photographer makes no pricing guarantees outside of the terms of this contract, and the Clients acknowledge that prices for additional goods or services are subject to change suddenly and without notice.

Responsibilities

LSALM Photography will be the sole and exclusive photographer for the above-listed events. Photographer is responsible for bringing any equipment or assistants necessary to conduct the services outlined in this contract. Clients agree to prevent any other photographers or videographers at the events listed in this contract from interfering with the Photographer’s performance of their duties. This includes wedding guests and other photographers or videographers. Photographer will not be held liable for compromised event coverage due to interference from other parties, including late arrivals by members of the wedding party or their guests. Likewise, Photographer is not responsible for degraded coverage due to environmental issues, such as poor event lighting, space, or backdrops. It is the responsibility of the Clients to be on time and the Clients are responsible for ensuring the bridal party being on time. It is the responsibility of the photographer to be on time. The Photographer is not responsible for compromised coverage due to causes beyond the control including, but not limited to obtrusive guests, lateness of the Client or guests, weather conditions, schedule complications, incorrect address(es) provided, rendering of decorations, or restrictions of the location(s), backgrounds or lighting conditions which may negatively impact or restrict the photography coverage. The Photographer will not be held accountable for failure to deliver images of any individuals or any objects. The Client is responsible for acquiring all permits and necessary permission for all locations on which the Photographer will be performing services. Photographer has all rights to shoot within the time booked and to cease shooting when that time expires. In the event that the photographer chooses to continue shooting (if there is available time), Clients have no rights to those images unless compensated for at the prior outlined rate.

Harassment

The Clients acknowledge that they are responsible for ensuring appropriate behaviour by their guests, wedding party, and other vendors. In the event that the Photographer identifies any inappropriate, threatening, hostile, or otherwise offensive behaviour directed at them, their assistants, or their equipment, Photographer reserves the right to end coverage of the events, retain all fees paid by the Client, and hold no further responsibilities to the Clients. Photographer agrees to notify the Clients of any of the above-listed behaviours, and give them an opportunity to correct such behaviours, or remove the offending individuals from the venue prior to ending event coverage.

Coverage

Photographer will provide the goods and services listed in this wedding photography contract, including event coverage for the listed hours at the venues listed. If additional coverage hours are requested on the day of the events, Clients agree to pay the Photographer in full for those additional hours at the hourly rate listed in this package detail for which this contract enforces. Photographer agrees to make every effort to provide satisfactory coverage, but cannot make any guarantees as to specific photos, poses, etc during the event.

Meals

The photographer, videographer and assistant(s) are expected to have a reserved seat at a table or at least a space for mealtimes, and, are expected to receive a meal(s). It is understood that all special moments are expected to be captured and they will be.

Image Processing

Photographer will perform limited colour correction and retouching prior to delivering any physical copies of images to the Clients. Photographer is not responsible for the printed copies of images delivered to the Clients as electronic files. The Clients may request additional physical copies of images and footage from the event within 7 days of receiving images.

Model Release

This wedding photography contract serves as a model release. This grants the Photographer the right to use all images and footage without restriction for advertising, portfolios, and other lawful purposes. 

Copyright

All photographs and footage are and shall remain the sole intellectual property of the Photographer in accordance with Jamaica Copyright Laws. The Clients hereby waive any rights to intellectual property ownership, monetization, or reproduction of the images and footage created by the Photographer, with exception of the terms of any formal written releases provided to the Client by the Photographer. Clients have the right to print and keep copies of the images for personal purposes.

Unauthorized Reproduction

Client agrees not to reproduce or modify the images or footage provided by the Photographer without first obtaining a formal written release signed by the Photographer. Should the Photographer discover any violations to this agreement, the Clients agree to be held financially responsible at a rate of US$1,000 per violation. If photos are reposted, uploaded to social media or used for print media, credits must be given to the photographer by a tag and/or mention in a caption as is applicable.
